SOUTHBROOK CONDOMINIUM ASSOCIATION

BYLAWS AND POLICIES (condensed)

 Updated February 2026


BYLAWS:


Fees:  The monthly Association fee is $250. There is a $250 non-refundable transaction fee per unit for entrance into the Association when a unit is purchased. Fees are due the 1st of each month and are considered delinquent after the 15th of the month.  Delinquent fees shall be assessed a penalty of $25 for each month of delinquency.  Upon 90 days of delinquency of these monthly fees, a lien shall be filed against that unit. Hardship cases may apply to the Board of Directors for consideration of leniency on an individual basis. (Document 2870642, PDF pg 107)


Building Insurance:  Insurance for building exteriors, common elements, and interiors as originally constructed is billed separately from monthly association fees in May of each year ($540 for 2025).  Individuals should purchase insurance for the contents and interior of their unit from the carrier of their choice. Southbrook's insurance carrier is HUB International (QBE).  (Film 85 pg 1816, PDF pg 28)


What You Own: You own and are responsible for the interior of the unit plus half width of the walls in. As well as, windows, doors, external heating/cooling, utility lines that serve your unit, a designated garage plus garage door. (Film 85 pg 1798, PDF pg 11)


Parking: Curbside parking is prohibited in the complex (Film 105 pg 3176, PDF pg 75). No more than two vehicles per unit are to be parked in the complex. Units with two vehicles are required to park at least one vehicle in their garage or on the pad in front of the garage. Motorcycles and motor scooters are considered vehicles and may be allowed as a third vehicle per unit as long as they are parked in the garage. Only vehicles owned by residents are to be parked in the complex on a regular basis. Disabled vehicles (flat tires, wrecks, etc.) may only be parked in the complex for a period not to exceed 48 hours. Recreational vehicles (motor homes, boats, trailers) may be parked in the complex for a period not to exceed 48 hours. Bicycles are to be stored in garages and are not allowed on decks, landings, stairways or other common areas. All motorized vehicles owned by Southbrook residents must be registered with the Board of Directors. (Document 2398363, PDF pg 100)


Windows and Doors: All doors and windows installed on the property shall adhere to a uniform standard and must be approved by the Southbrook Condo Association Board. (Document 2870642, PDF pg 108)


Pets: No more than two pets shall be permitted per unit. “Pets” are hereby defined as cats or dogs. Dogs must be always on leash when they are outside of an owner’s unit.  Owners must pick up dog feces promptly and repeated urination in the same spots causing damage to lawns and shrubs is not allowed.  Pets making disturbing noises or displaying aggressive behavior are not allowed. All cats must wear bells or other devices to always minimize predation to wildlife they are outside of an owner’s unit. Pets may only be tethered to the owner’s patio. (Document 2331223, PDF pg 95)


Sound Systems:  No sound systems may be played either within a unit or on common elements at a level which is audible to another unit.  (Film 103 pg 1573, PDF pg 67)


Firewood: No firewood may be stored anywhere but in the owner's own garage. (Film 85 pg 1805 H., PDF pg 18)


Personal Property: Personal property should not be stored anywhere else but inside the condo unit or garage. Entryways should be kept maintained in accordance with neighboring units.  Film 85-1804. (Film 85 pg 1805 6., PDF pg 18)


Exterior Alterations:  No owner may change, alter, or remodel the exterior of the unit without prior written consent of the Association.  Requests should be in writing to the Board President.  (Film 85 pg 1814 4., PDF pg 27)


Use of Unit:  The use of all units shall be for residential purposes only and no commercial use.  (Film 85 pg 1803, PDF pg 16)


Displays:  Unit owners should not hang or display anything on the outside of the windows or walls of a building. No sign, awning, canopy, radio or TV antenna shall be affixed to or placed upon the exterior wall or roof without prior consent of the Association.  (Film 85 pg 1804 C., PDF pg 17)


Violation of Bylaws/Policies:  Unit owners in violation of the By-laws and Policies can have fines levied against them by the Board of Directors. A first-time violator will receive a written notice. The 2nd offense is a $50 fine, the 3rd is $75, and the 4th is $100 and so forth. Unpaid fines after 90 days will result in a lien being placed on that unit. Unit owners are responsible for violations incurred by their renters at a rate 50% higher ($75, $112.50 $150 and so forth). (Document #249643, PDF pg 105)


Barbecue Grills/Portable Fire Pits: Charcoal-fired grills, portable fire pits or similar devices used for cooking, heating, or any other purpose are not allowed. Gas-fired grills and electric grills are allowed. A fire extinguisher must be on hand during grill use. Grills must not be left unattended while in operation. (Document 2407128, PDF pg 101)


Leasing Policy: No more than thirty-five percent (35%) of the units of Southbrook Condominium Association may be leased at any given time to a Third Party.  Any Owner engaged in leasing or subleasing activities as of the date of this Amendment shall be allowed to continue leasing or subleasing activities until said Unit is sold or conveyed to a Third Party.  Any Unit Owner engaged in leasing or subleasing activity must, upon the sale or conveyance of said Unit, notify any potential buyer or person taking title that no more than thirty-five percent (35%) of the Units of Southbrook Condominium Association may be leased at any given time to a Third Party. For the purpose of this provision, “Third Party” shall be defined as any person who is not an Owner as that term is defined in the Declarations.  All lease agreements must be submitted to the Board of Directors prior to execution by the Owner.  Owners shall also submit a “Unit Rental Agreement” to the Board of Directors for each tenant/lease (Document # 2361577) no less than thirty (30) days prior to executing or extending a lease.  Additionally, if an Owner fails to provide the “Unit Rental Agreement” to the Board of Directors as outlined above, the Board may impose reasonable monetary penalties according to the By-Law Violation Policy.


No owner may lease a Unit for fewer than twelve (12) months. 


Owners may apply for a hearing before the Board for temporary or special variances in case of hardship. Permission to lease will be granted at the sole discretion of the Board of Directors. (Document 2496431, PDF pg 104)


Rental Agreements: No Southbrook Condominium unit will be rented, leased or otherwise occupied unless and until the Association's "Unit Rental Agreement" has been signed by the prospective tenant(s)/occupant(s). All residents of Southbrook who are not the owner of record must abide by this policy. It is the sole responsibility of the unit owner to obtain these signatures and submit the executed document to the Board of Directors before occupancy. Failure to comply with this provision shall be sufficient cause for the Association's Board of Directors to levy fines against unit owners according to the By-law Violation Policy. Unit owners are liable for fines levied due to By-laws/Policies violations by tenants/occupants of their unit(s). (Document 2361577, PDF pg 96)


POLICIES: are put in place by the board to explicitly state processes or define broad bylaws


Trash:  Containers for trash are to be stored in garages. Containers should be set out at the curbside the night before or the morning of collection and then promptly returned to garages within 2 days. (Film 85 pg 1805 6., PDF pg 18)


Washers/Dryers:  Should not be operated before 7AM or after 10:30 PM. (Film 85 pg 1805 E., PDF pg 18)


Winter:  When absent from the unit, set the thermostat at 55 degrees or higher and leave kitchen and bathroom cupboard doors open. Leave a key with the manager or a neighbor so inspection can be made in extremely cold weather.  This policy has been established to avoid frozen pipes and subsequent damage from water leakage. Rentals/Leasing: We have established a rental waitlist as only 30 units can be classified as rentals. You are placed on the list at the time you email a request to the resident manager. An owner has 60 days after notification to decide if they would like to convert to a rental unit. After the initial notification that they may convert the unit they have 90 days to obtain a renter. A unit may be removed from the waitlist or have their permission to lease revoked at the board’s discretion if they have unpaid fees or fines.  (Document 2496431, PDF pg 104)
